Terms and conditions

§ 1 Scope

(1) These terms and conditions apply to all contracts for digital content (template folders for download) concluded via this website with Lukas-Domenik Sonnenfeld, Anschrift siehe Impressum (“we”).

(2) Customers may be consumers (§ 13 BGB, German Civil Code) or traders (§ 14 BGB). We supply customers in the member states of the EU, Norway, Iceland, Liechtenstein, Switzerland, the USA, Canada and the United Kingdom; we do not currently sell to consumers in the United Kingdom.

(3) Any deviating terms of the customer only apply if we expressly agree to them in text form.

§ 2 Contact

Phone: siehe Impressum · Email: sunfieldshops@gmail.com · further details in the legal notice.

§ 3 Conclusion of the contract

(1) The presentation of the folders on this website is not a binding offer but an invitation to place an order.

(2) Ordering process: you choose a folder, check the product, price and delivery method in the order summary, and enter your name, email address and country. You can correct input errors directly in the fields until you submit, or choose a different folder via “change”. By clicking one of the buttons “Order with obligation to pay – PayPal” or “Order with obligation to pay – card, Apple Pay, Google Pay, Klarna, SEPA & more” you make a binding offer to conclude a purchase contract. If the order cannot be transmitted directly for technical reasons, your email program opens with the prepared order instead; you then make the offer by sending this email.

(3) We confirm receipt of your order by email. The contract is concluded when we accept your order by email or send you the download link, but at the latest when we accept your payment.

(4) The language of the contract is German; this English text is a translation for your convenience. We store the text of the contract. You will receive the contractual terms, including these terms and conditions, with the confirmation by email.

(5) We have not submitted to any particular codes of conduct.

§ 4 Prices and payment

(1) All prices are final prices in euros. VAT exempt under § 19 German VAT Act (UStG) – no VAT is charged. No shipping costs apply.

(2) Payment is made, at your choice, via PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg) or via the payment service Stripe (Stripe Payments Europe, Ltd., Dublin) using the payment methods offered there, e.g. card, Apple Pay, Google Pay, Klarna or SEPA Direct Debit. Depending on what PayPal offers, you may also pay there without a PayPal account, for example by card. If you pay via Stripe, you enter your payment details only on Stripe’s payment page; the purchase price is due immediately upon ordering. The terms of the chosen payment service apply in addition.

§ 5 Delivery of digital content

(1) The content and scope of the folders are described on the respective product page (contents, format, system requirements). The folders are in German.

(2) Once your payment has been received, you will get the download link by email within 2 working days at the latest. The link is valid for at least 30 days; we will send it again on request.

(3) The technical requirements (e.g. a PDF reader) are listed on the product page.

§ 6 Right of use

(1) Upon full payment, you receive a simple, non-transferable right to use the folder for one business (a company or a self-employed person), including everyone working there.

(2) You may use the texts created with the templates without restriction.

(3) You may not resell, give away, rent out or make publicly available the folder or individual templates.

§ 7 Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. Details are set out in the information on the right of withdrawal, which you will receive with the order confirmation together with the model withdrawal form. You can also withdraw from the contract via the button “Withdraw from contract”. For digital content, the right of withdrawal expires early under the conditions stated in the information on the right of withdrawal. Traders have no statutory right of withdrawal.

§ 8 Rights in the event of defects

The statutory rights for defects in digital products apply (§§ 327 et seq. BGB). We give no additional guarantee.

§ 9 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.

(2) In cases of slight negligence, we are only liable for breach of an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.

(3) The folders are working aids. They are no substitute for legal, tax or data protection advice. You are responsible for any texts you create and use with the help of the templates and an AI service.

§ 10 Consumer dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
